Please review these Terms of Service carefully, as they outline key information regarding your rights, responsibilities, and legal obligations when using Exotics.Luxe. By agreeing to these terms, you acknowledge and accept provisions that include a mandatory arbitration agreement (unless you opt out), restrictions on class and representative actions, and limitations on liability and remedies. These terms also define jurisdiction, venue, and governing law for dispute resolution, except where prohibited by law. Additionally, all guests are required to comply with all applicable laws and regulations while using our services.

Terms of Service – Introduction

Exotics.Luxe (“Exotics.Luxe,” “we,” or “us”) provides a premium car rental and transportation service, offering luxury vehicles to travelers and locals seeking an upscale driving experience. Our services are accessible online, including through our website and mobile applications. The Exotics.Luxe website, blog, mobile apps, and related services are collectively referred to as “the Services.” By accessing or using the Services, including by communicating with us or other users, you agree to comply with and be legally bound by these Terms of Service (“Terms”), whether or not you become a registered user. These Terms govern your access to and use of the Services and constitute a legally binding agreement between you and Exotics.Luxe.

These Terms, along with our cancellation policy, nondiscrimination policy, applicable insurance terms, roadside assistance terms, and other additional policies (collectively, the “Policies”), form the “Agreement” between you and Exotics.Luxe (each a “Party,” collectively, “the Parties”). Additionally, we provide a Rental Agreement summarizing the terms of each reservation, which is accessible within the Services for booked or past rentals. Exotics.Luxe acts as the intermediary for transactions between the guest booking a vehicle and the company providing the rental.

Modifications

We reserve the right, at our sole discretion, to modify the Services or these Terms at any time. If any modifications are made, they will be posted on the Services, and the “Last Revised” date at the top of these Terms will be updated accordingly. By continuing to use the Services after a modification is posted or after receiving notice of a change, you indicate your agreement to the updated Terms. If you do not agree to the modified Terms, your sole option is to discontinue use of the Services and close your account within 30 days. If you choose to close your account, the previous version of these Terms will remain applicable unless you access the Services within the 30-day period, in which case the updated Terms will apply.

Eligibility, Registration, and Verification

Eligibility

The Services provided by Exotics.Luxe are exclusively available to guests who meet the eligibility requirements in the location where the vehicle is rented. To rent a vehicle, guests must meet minimum age requirements and provide a valid driver’s license and proof of insurance if applicable. To list a vehicle as a host (if applicable), individuals must be at least 21 years old. Any use of the Services by individuals who do not meet these eligibility requirements is strictly prohibited.

Registration

To access and utilize certain features of the Exotics.Luxe platform, guests are required to create an account (“Account”). During the registration process, guests must provide accurate, current, and complete information, including their full name, email address, mobile phone number, and a secure password. Guests may also have the option to register using a third-party service such as Apple or Google.

When booking a vehicle, guests may be required to provide additional verification details, including a valid driver’s license and other identifying information. Similarly, hosts listing vehicles (if applicable) must submit details regarding their vehicle(s) and ownership information. To maintain an active Account, users must ensure their information remains accurate and up to date.

Depending on the details provided, Exotics.Luxe may impose additional requirements for booking a rental, such as providing a security deposit, verifying a secondary form of payment, or purchasing a specific level of rental protection.

Verification

Where permitted, Exotics.Luxe reserves the right—but is not obligated—to conduct screenings and identity verifications to ensure safety and compliance. These screenings may include, but are not limited to:

  1. Verifying user identity, including checking driving history and the validity of a driver’s license.
  2. Confirming vehicle details to ensure they meet the company’s rental requirements.

Exotics.Luxe does not explicitly endorse, guarantee, or certify the background, driving record, or identity of any user. We may use third-party services to validate information and obtain additional verification details, and by using the Services, guests and hosts authorize Exotics.Luxe to request, receive, store, and use such information.

The company reserves the right to accept or deny any booking or vehicle listing at its sole discretion. While we strive to uphold safety and quality standards, it remains the host’s sole responsibility to ensure that all vehicles are:

  • In safe and operable condition
  • Legally registered for public road use
  • Free from salvage, branded, or written-off titles
  • Not subject to any open safety recalls
  • Compliant with all vehicle eligibility requirements

Consumer Report Authorization

By booking or listing a vehicle through Exotics.Luxe, users authorize the company to conduct background screenings as permitted by law. This may include obtaining a consumer credit report, auto insurance score, and/or criminal background check where applicable. These checks may be performed at the time of registration, during a booking request, or at any later time when there is reason to believe there may be an increased level of risk associated with the user’s account.

This authorization is in accordance with the Fair Credit Reporting Act (FCRA), applicable consumer reporting laws, and other relevant regulations.

Fees & Taxes

Fees

The fees associated with using Exotics.Luxe are clearly itemized at checkout for guests. Before submitting a rental request, you will have the opportunity to review and verify the total cost of your trip, including applicable fees. Hosts (if applicable) can view their earnings breakdown within their account dashboard.

By providing Exotics.Luxe with a valid payment method, you authorize us (or third-party payment processors acting on our behalf) to store and charge your payment credentials for any outstanding balances owed. These balances may include rental fees, security deposits, late fees, processing fees, claims-related costs, and administrative charges.

In some instances, our payment processors may automatically update stored payment credentials if your payment card is replaced, renewed, or reported lost/stolen, ensuring a seamless billing experience. If we attempt to issue a refund and your original payment method is no longer valid, we reserve the right to provide account credit in place of a direct refund. The use of any account credit is subject to our credit terms and conditions.

Additionally, Exotics.Luxe may offer promotional codes at our discretion, which will be subject to the specific terms of the promotion and our general policies.

Collection of Fees

To recover any outstanding payments, Exotics.Luxe and its service providers may use all legal methods available, including engaging collection agencies or legal counsel. Unpaid balances, late payments, or chargebacks may result in:

  • Additional collection fees, processing charges, or third-party service fees
  • Reporting of delinquent accounts to credit bureaus, which may impact your credit score

If we report information regarding your account to a credit bureau (e.g., Experian, Equifax, or TransUnion), and you wish to dispute it, please contact us. If a collection agency reports information to a credit bureau regarding your account, you must contact the collection agency directly.

Taxes

In certain jurisdictions, Exotics.Luxe may be required to collect and remit applicable taxes on behalf of guests or hosts, in accordance with local tax regulations and marketplace facilitator laws. Any applicable taxes will be:

  • Clearly itemized on trip-related invoices for both guests and hosts
  • Collected and remitted as required by law

Where Exotics.Luxe is responsible for facilitating tax collection and remittance, hosts (if applicable) are not permitted to collect the same taxes separately within those jurisdictions.

Additionally, in compliance with global tax regulations such as EU Council Directive 2021/514 (DAC7), Canada's Digital Platform Reporting Rules, and Australia’s Sharing Economy Reporting Regime (SERR), Exotics.Luxe may be required to report unadjusted gross earnings of hosts (if applicable). This includes all rental transactions before deductions for service fees, reimbursements, or credits.

For any tax documentation required, you consent to electronic delivery of your records and reporting statements.

Late Return Policy

At Exotics.Luxe, we strive to provide a seamless and luxury rental experience for all customers. To ensure the availability of our high-end vehicles and maintain fair scheduling, we have implemented the following Late Return Policy:

  1. 1-Day Late: If the renter fails to return the vehicle within 24 hours of the scheduled return time, a 10% late fee will be charged based on the total trip cost.
  2. 2-Day Late: If the renter has not returned the vehicle within 48 hours of the scheduled return time, a 20% late fee will be applied to the total trip cost.
  3. Repossession & Forfeiture: If the renter has not returned the vehicle and paid the outstanding balance by 5:00 PM on the second day, Exotics.Luxe reserves the right to repossess the vehicle immediately. Additionally, the renter will forfeit their full security deposit to cover administrative, recovery, and inconvenience costs.

Additional Terms:

  • Renters must contact Exotics.Luxe immediately if they anticipate a late return to discuss possible extensions (subject to availability and additional charges).
  • All late fees and outstanding balances must be paid before 5:00 PM on the second day to avoid repossession.
  • Any costs associated with repossession, legal action, or additional recovery fees will be the full responsibility of the renter.

By renting with Exotics.Luxe, you acknowledge and agree to abide by this Late Return Policy. Failure to comply may result in legal action and permanent disqualification from future rentals.

Your Commitments

By using the services of Exotics.Luxe, you agree to comply with these Terms of Service, all applicable laws, and any additional policies and standards provided by the company.

Account Activity

You are solely responsible for all activity associated with your Exotics.Luxe account. To ensure security, you agree to:

  • Keep your login credentials secure and not share your password with any third party.
  • Take full responsibility for any actions performed under your account, whether authorized by you or not.
  • Notify us immediately of any unauthorized access or suspected security breaches.

Exotics.Luxe is not liable for unauthorized use of your account unless you have reported the issue in a timely manner.

Content Usage & Ownership

Company and User Content License

Subject to compliance with these Terms, Exotics.Luxe grants you a limited, revocable, non-exclusive, non-transferable license to access and view content on our platform for personal, non-commercial use only. You may not sublicense, copy, distribute, or modify any content without prior written permission.

User-Generated Content

You may be permitted to upload or share content, including photos, reviews, and feedback related to your rental experience. By submitting content through our Services, you grant Exotics.Luxe a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license (with the right to sublicense) to use, display, modify, distribute, and promote your content for marketing and business purposes.

While we do not claim ownership of user-generated content, we reserve the right to remove or modify content that violates our policies.

Copyright Protection

If you believe that content on our platform violates your copyrights, you may submit a copyright infringement notice in accordance with the US Digital Millennium Copyright Act (DMCA) and other applicable laws.

Google Services Usage

Certain features of our Services utilize Google Maps, Google Places API, and reCAPTCHA Enterprise to prevent spam and abuse. By using our platform, you agree to be bound by Google’s Terms of Service.

Prohibited Activities

By using Exotics.Luxe, you agree not to:

Violations of Laws & False Information

  • Violate any local, state, or federal laws, including traffic regulations, tax laws, or licensing requirements.
  • Provide false or misleading information, including identity, driver’s license details, payment methods, or insurance information.
  • Impersonate another individual or misrepresent your affiliation with a company or entity.

Intellectual Property & Brand Protection

  • Infringe upon copyrights, trademarks, or patents owned by Exotics.Luxe or other third parties.
  • Register domain names, trade names, or social media handles that are confusingly similar to our brand without authorization.

Failure to Honor Agreements

  • Fail to pay rental fees, penalties, or other charges owed.
  • As a guest, fail to return a rented vehicle on time without a valid reason.
  • Attempt to circumvent the platform by making direct rental arrangements outside of our system to avoid paying associated service fees (gray market transactions).

Unauthorized Use of the Platform

  • Transfer or sell your rental account or user ID without company approval.
  • Leave a rental vehicle unlocked or unattended with the keys inside, except when specifically directed by Exotics.Luxe.

Harming Other Users & Harassment

  • Harass, stalk, defame, or intimidate other users.
  • Collect or store personal information about other users without consent.
  • Engage in discrimination based on race, gender, religion, nationality, or other protected statuses—Exotics.Luxe does not tolerate discrimination of any kind.

Misuse of Services for Unrelated Purposes

  • Contact other users for unrelated business or commercial solicitation.
  • Use the platform to distribute spam, unsolicited messages, or commercial advertisements.
  • Recruit users to join competing services without prior written consent.

Interference with Platform Operations

  • Interfere with, disrupt, or manipulate the normal functioning of the platform.
  • Introduce viruses, malware, denial-of-service attacks, or other harmful code.
  • Use bots, crawlers, or data scraping methods to extract user data without authorization.
  • Bypass security measures, access restricted areas, or attempt unauthorized penetration of our network.

Avoiding Platform Enforcement & Fraudulent Behavior

  • Attempt to circumvent an account suspension or termination by creating a new account.
  • Decompile, reverse-engineer, or attempt to hack our software or proprietary technology.
  • Forge TCP/IP headers or falsify digital identifiers to mislead or deceive users.

Violating any of these terms may result in immediate suspension or termination of your account, legal action, and permanent banning from our services.

Other Legal Matters

Violations

Exotics.Luxe reserves the right—but not the obligation—to investigate, take legal action, or refer violations of this Agreement to law enforcement to the fullest extent permitted by law.

We also retain the right to remove or restrict access to content that, at our sole discretion, is deemed objectionable, in violation of these Terms, or harmful to our Services or community. If we determine that a user is abusing the platform, violating policies, or harming other users, we may:

  • Limit, suspend, or terminate your account
  • Remove or restrict access to your content
  • Deny damage claims
  • Remove or demote listings
  • Reduce or eliminate discounts
  • Take legal or technical steps to prevent future use of our Services

If a rental listing is artificially priced above market rates or if a host has an unreasonably high cancellation rate, we may restrict the listing or remove the user from our platform. Additionally, we reserve the right to deny access to our Services to anyone, at any time, at our sole discretion, to the fullest extent permitted by law.

Policy Enforcement

When addressing violations, Exotics.Luxe may take into account a user's performance history and specific circumstances before applying penalties. In some cases, we may choose to exercise leniency where appropriate, at our sole discretion.

Communications

By using our Services, you agree that Exotics.Luxe may contact you via email, in-app notifications, or other electronic means instead of mailed notices. Additionally, to improve efficiency, we may contact you via autodialed or prerecorded calls and text messages for purposes such as:

  • Confirming account setup
  • Notifying you about account activity
  • Investigating or preventing fraud
  • Collecting unpaid balances
  • Delivering urgent messages

We will not use these methods for marketing purposes, and we will not share your phone number with third parties for their own purposes without your consent. Standard call, text, and data rates may apply. You may revoke your consent to such communications at any time.

You further authorize Exotics.Luxe and its service providers to monitor or record phone calls or chat interactions for quality control, training, or other operational purposes. If you do not wish to be recorded, please contact us in writing instead of using our call or chat features.


Insurance & Protection Plans

Exotics.Luxe is not an insurance company and does not directly insure guests or hosts. However, we offer protection plans to help manage liability and damage coverage, which are subject to specific eligibility requirements and terms.

To benefit from a protection plan, hosts and guests must comply fully with these Terms. Availability of protection plans varies based on location. Please refer to the specific protection plan terms for additional details.


Guest-Specific Terms

Guest Commitments

By booking a rental with Exotics.Luxe, you agree to:

  • Hold a valid driver’s license and provide proof upon request.
  • Treat the vehicle with care and return it in the same condition it was received.
  • Ensure only Approved Drivers operate the vehicle, as indicated in the reservation details.

No Right of Withdrawal

For guests residing in the European Economic Area (EEA) or the United Kingdom, Exotics.Luxe does not provide a right of withdrawal for bookings. Transport services are time-specific, and cancellations are governed by our cancellation policy. Guests may, however, modify their protection plan before the rental begins.

Guest Financial Responsibility for Vehicle Damage

The guest who books the rental (“primary guest”) is fully financially responsible for:

  • Any physical damage, theft, or loss of the vehicle during the rental period.
  • Any additional costs or fees related to the damage.
  • Liability for damages, regardless of fault, unless covered by applicable protection plans or insurance.

Guests may have coverage through their personal auto insurance. However, by booking a vehicle, you agree to work with Exotics.Luxe in the event of an insurance claim.

Guests can limit their out-of-pocket expenses by selecting an available protection plan. However, this does not cover:

  • Mechanical or interior damage
  • Damage caused by policy violations

Failure to comply with these Terms may result in voided protection coverage.

Liability Insurance & Legal Protection

Hosts cannot offer liability insurance to guests. However, in certain jurisdictions, rental bookings may include liability protection under a third-party automobile insurance policy. Terms and exclusions apply.

If a guest has their own personal auto insurance, it will generally be primary over any liability protection provided with the rental. Commercial use of the vehicle may require additional coverage.


Proper Vehicle Use

When booking a vehicle through Exotics.Luxe, you must:

  • Use the vehicle for personal or business purposes only, unless you obtain written permission for commercial use.
  • Operate the vehicle safely and follow all traffic laws (e.g., speed limits, DUI regulations).
  • Return the vehicle on time and in the designated location.
  • Keep the vehicle secure (e.g., do not leave it unlocked or running unattended).

If we have concerns about your use of the vehicle, we reserve the right to terminate your rental immediately and recover the vehicle.

Failure to comply with proper vehicle use policies may:

  • Void protection coverage
  • Result in financial liability for damages

Vehicle Tracking & Telematics

Some vehicles may be equipped with telematics devices that monitor:

  • Vehicle condition & diagnostics
  • Location & mileage
  • Speed & driving behavior

By booking a rental, you consent to the collection and use of telematics data, as permitted by law.

If a vehicle telematics system fails, Exotics.Luxe is not liable for any damages or losses resulting from the malfunction.


Vehicle Condition & Inspection

  • Hosts are responsible for ensuring their vehicles are safe, roadworthy, and legally registered.
  • Guests should inspect the vehicle before their trip begins. If any pre-existing damage is found, guests should document it with photos at the start of the rental.
  • Failure to report damage before starting the trip may result in financial liability for the guest.

Incident & Theft Reporting

Reporting Damage or Theft

If a vehicle is damaged or stolen, guests must immediately report the incident to Exotics.Luxe. In certain locations, police reports may also be required.

  • In the U.S., U.K., and Australia, guests must report all collisions to the police.
  • In Canada, any collision causing more than $2,000 in damage must be reported.
  • In France, police reports are required for incidents involving personal injury.

Failure to report an incident or cooperate with an investigation may invalidate protection coverage.

Vehicle Theft

If a guest fails to return a vehicle or provides false information, the vehicle may be reported as stolen, potentially leading to:

  • Legal penalties & arrest
  • Permanent ban from the platform
  • Loss of protection plan coverage

A $500 administrative fee will be imposed if a vehicle is reported stolen due to non-return.

Repossession & Missing Vehicles

Exotics.Luxe may repossess a vehicle if:

  • It is not returned on time
  • It is illegally parked or abandoned
  • It is used in violation of these Terms

If a vehicle goes missing or is stolen, guests must:

  • Return the original keys
  • File a police report within 12 hours
  • Cooperate fully with law enforcement and our team

Failure to comply with these procedures may result in legal action and full financial liability.

Host-Specific Terms

The following provisions apply to hosts listing their vehicles through Exotics.Luxe.


Host Commitments

By listing a vehicle, you agree to:

  • Provide a safe, legally registered, and insured vehicle with current license plates.
  • Ensure the vehicle has a clean title (non-salvaged, non-branded, non-written-off) and is in good mechanical condition.
  • Deliver the vehicle on time to the guest listed as an Approved Driver.
  • Not collect additional personal information from guests beyond verifying their driver’s license.
  • Not conduct background checks or gather guest personal data beyond what is provided through our Services.
  • Ensure all listing details (vehicle condition, pricing, and extras) are accurate and honored.
  • Not cancel bookings to seek a higher price from another guest.
  • Not offer vehicles or extras you do not legally own or have authority to rent.
  • Not list a vehicle subject to an open safety recall without properly addressing the issue.
  • Remove firearms or other weapons from the vehicle before providing it to a guest.

If your vehicle is leased or financed, you are responsible for ensuring that listing it with Exotics.Luxe does not violate your agreement with the lienholder.


Vehicle Listing & Information

When listing a vehicle, you must:

  • Provide accurate license plate and VIN details.
  • Only list vehicles you own or have legal permission to share.
  • Comply with tracking and technology requirements if your vehicle has built-in telematics or location services.

Search Result Rankings

Vehicle listings are ranked based on:

  • Guest search criteria
  • Vehicle location, price, and delivery conditions
  • Host ratings, commitment rate, and All-Star Host status

Hosts cannot pay to boost listings, and we do not offer sponsored rankings.


Exclusive Listing Requirement (U.S. & Australia)

If you list a vehicle on Exotics.Luxe in the United States or Australia, you may not list the same vehicle on any other car-sharing marketplace. Violating this policy may result in:

  • Fines & penalties
  • Denial of damage claims
  • Removal of the vehicle from the platform
  • Account suspension or termination

Photography Policy

We may offer professional photography services for your vehicle listing. By using this service, you:

  • Acknowledge that Exotics.Luxe retains exclusive ownership of all images.
  • Agree that images may be used for advertising and marketing purposes.
  • Waive any royalty rights or moral rights in the images.
  • Agree not to use these images for any listings outside of Exotics.Luxe.

Vehicle Availability & Delivery

  • Once a trip is booked, you must ensure the vehicle is available at the agreed location.
  • If offering vehicle pickup, you must provide an accurate pickup location.
  • To qualify for a protection plan, you must:
    • Verify the guest’s driver’s license before handing over the vehicle.
    • Ensure the guest matches the name on the reservation and photo on the license.

Pricing, Earnings & Payments

  • Hosts set their own rental prices and can adjust rates as needed.
  • Exotics.Luxe deducts applicable fees from guest payments before disbursing earnings to hosts.
  • If you owe outstanding payments to Exotics.Luxe, we may:
    • Deduct amounts from your earnings.
    • Debit your bank account or charge your saved payment methods.
    • Send you an invoice for collection.

Payment Processing

  • Payments may be processed through Stripe, and hosts using Stripe are subject to Stripe’s Terms & Conditions.
  • Exotics.Luxe is not liable for Stripe-related payment issues.

Airport Deliveries & Legal Compliance

  • Some airports require permits and fees for car-sharing services.
  • Hosts are responsible for ensuring compliance with airport regulations.
  • Additional personal vehicle sharing regulations may apply in certain jurisdictions.

Vehicle Maintenance Requirements

As a host, you must:

  • Regularly inspect and maintain your vehicle to ensure safety.
  • Keep the vehicle registered, insured, and in roadworthy condition.
  • Address any recalls or safety notices before listing the vehicle.
  • Remove vehicles that fail to meet platform standards until issues are resolved.

Co-Hosting & Hosting Teams

Hosts may assign Co-Hosts to help manage listings. By doing so, you:

  • Acknowledge that Co-Hosts act on your behalf.
  • Accept responsibility for their actions.
  • Agree that Co-Hosts are not employees of Exotics.Luxe.
  • Understand that Exotics.Luxe is not liable for disputes between hosts and Co-Hosts.

You can remove Co-Hosts at any time, but you remain responsible for their previous actions related to your listings.


Reporting Vehicle Damage

If you did not decline a protection plan, and your vehicle is damaged during a rental, you must:

  • Report the damage within 24 hours of the scheduled return time.
  • Cooperate fully with the investigation and claims process.

Failure to report damage promptly may result in denied claims.


Insurance & Liability Protection

Liability Coverage for Hosts

For trips originating in the U.S., U.K., France, and Canada, Exotics.Luxe provides third-party liability coverage. Coverage varies by region and is subject to:

  • Policy exclusions & limitations
  • Local regulations

Physical Damage Coverage

Hosts who select a protection plan may receive reimbursement for vehicle damage. Coverage varies by country:

  • U.S. & U.K.: Reimbursement for physical damage due to collision/comprehensive events.
  • Canada & France: Protection for physical damage, subject to terms.
  • Australia: Protection provided by a discretionary mutual, not insurance.

Hosts may be required to transfer the vehicle title or accept a salvage deduction if receiving an actual cash value payout for a total loss.

Exclusions to Damage Coverage:

  • Damage to optional extras or personal property.
  • Normal wear & tear.
  • Failure to comply with platform policies (e.g., misrepresenting vehicle details).

Hosts must maintain valid insurance & registration on listed vehicles. If requested, hosts must provide proof of insurance to Exotics.Luxe.


Missing Vehicles & Theft

If a rented vehicle is missing or stolen, hosts must:

  • Immediately contact Exotics.Luxe.
  • Cooperate fully with law enforcement.
  • File a police report within 24 hours (if instructed).

Failure to follow these steps may affect reimbursement eligibility.


Indemnification for Hosts

If you selected a protection plan, Exotics.Luxe or its insurance partners will defend and indemnify you against covered claims. Hosts must:

  • Provide timely written notice of claims.
  • Allow Exotics.Luxe full control of legal proceedings.
  • Cooperate fully in the claims process.

If you receive a third-party insurance payout for a claim already covered by Exotics.Luxe, you must reimburse any duplicate payments.


Dispute Resolution & Legal Considerations

Arbitration Agreement (U.S. Residents Only)

By listing a vehicle, you agree to resolve disputes through binding arbitration, rather than court. Exceptions include:

  • Small claims court disputes.
  • Injunctive relief claims for intellectual property issues.

If arbitration is not enforceable, legal disputes will be handled in Phoenix, Arizona courts.

Right to Opt-Out of Arbitration
